In 1984, the federal Bail Reform Act made the safety of victims and witnesses a factor in refusing or revoking pre- and post-trial bail. Son of Sam Statutes: In 1977, New York enacted the first so-called Son of Sam statute escrowing compensation to criminals for movies or books based on their version of the crimes and making it easier for victims to recover judgments against such criminals; by 1982, 22 other states had also enacted such statutes and Congress enacted its own form of "Son of Sam" statute in 1984.
Does the fact that the victim is not a party to a criminal proceeding have any legal consequences? Yes. Because the victim is not a formal party to the criminal proceeding, his input into the process is limited. The victim cannot force the prosecutor to take actions advocated by the victim or prevent him from taking steps opposed by the victim. In legal terms, the victim lacks standing, or the legal right to be heard by a court, with respect to prosecutorial decisions. Crime victims fall within the classic definition of persons with standing, because they suffer "injury in fact" and the laws that they seek to enforce, that is, criminal statutes intended to deter certain injuries to individuals, make their claims "arguably within the zone of interest" for which the statute was enacted.
These states have provided victims of crimes the right to be informed of state victim compensation programs, to be treated with dignity and compassion, to be provided with counseling and other forms of assistance by agencies established specifically to serve crime victims and to have certain procedural rights in the prosecution of the crime in which they were victimized, including the right to be notified of important developments in the case and to be heard on such questions as sentencing and parole.
